Sale of Goods

These Terms and Conditions govern the sale of goods available on our Site.

The following goods are available on our Site:

- Kitchen Worktops;

- Upstands; and

- Accessories.

We are under a legal duty to supply goods that match the description of the good(s) you order on our Site.

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock.

All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images.

Pricing - All prices are inclusive of VAT rates applicable at the time of ordering unless otherwise stated. In the event that there is a pricing error on the website, White Rose Group Ltd will not be bound to honour any orders made at that price.

Order Confirmations - On completion of your order, you will receive an email confirmation to the email address you have provided. Please note this does not mean your order has been accepted by us. The order is deemed accepted when you receive a secondary email confirming your delivery date.

Product Images and Descriptions - The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images. We encourage all customers to make use of our free sample service to ensure they are happy with the decor they have chosen.

Product Tolerances - Although we have made every effort to be as accurate as possible, all sizes, weights, capacities, dimensions, and measurements on our website are subject to a manufacturing tolerance. Please note that the sizes listed on the website may vary due to the cutting process of worktop related products and they are generally cut slightly longer than the sizes listed due to slight laminate scratches etc when cutting. However you will always receive a useable piece of worktop of the listed size.

Colour variation - We will always attempt to colour match goods ordered on a multiple basis. However, due to the natural characteristics of products and the manufacturing processes used, we cannot guarantee any replication of colour from piece to piece and from batch to batch. We reserve the right to change the décor of our products at any time and if this affects any order you have already placed with us, we will let you know.

Accurate Measurements - It is your responsibility to ensure you are ordering the correct size product based on your measurements. If you are ordering over the phone or via email, you must ensure the measurements provided to our team are accurate. If you order the incorrect size for your needs based on your measurements, and require a refund, any delivery fees will be deducted from your refund and you may incur a restocking fee. If you require a replacement product, you will be charged an additional delivery and collection fee.

You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Changes to Your Order

If you wish to make a change to your order once it has been placed, please contact us as soon as possible and we will do our best to accommodate your request and let you know if the change is possible.

Changes to your order may impact any prices such as delivery or storage fees. We will ask you to confirm if you accept these changes before confirming your request’s approval.

In some cases, we will not be able to accommodate your requested changes, such as if goods have already been dispatched or prepared for shipping. This is not an exhaustive set of examples and there may be other reasons why we cannot accept your request. Any reason will be explained to you at the time.

Free Sample Service

Any samples provided shall be treated as an approximate guide only. Colour and appearance may vary from sample to sample depending on which part of the worktop the decor sample was taken from and, while we attempt to make them as accurate a representation as possible, they may slightly differ to the sample you received. Any products sold by us are sold by description only and you accept this when ordering any products from us.

We accept the following payment methods on our Site:

- Credit Card; and

- Debit Card.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery

When you purchase goods from our Site, the goods will be delivered through one of the following methods:

- One-man worktop local delivery. We aim to deliver all products within 3-5 working days.;

- Sample delivery by first class Royal Mail. Delivery takes 1-2 working days.; or

- One-man accessory local delivery. We aim to deliver all products within 3-5 working days.

Please note that none of our manned delivery services permit our delivery driver to enter your home, this is for insurance purposes. Deliveries are to a ground floor external access point only. It is your responsibility to ensure you have the appropriate help with you at the delivery address to assist you in moving the goods indoors. If there are any obstructions preventing delivery into the nearest ground floor access point, our delivery personnel or the courier will place the products at the nearest safest point.

Upon delivery it is your responsibility to ensure that an able-bodied person is present during delivery to assist the driver with off-loading and carrying the goods. If nobody is present to assist the driver the goods will be taken back to the depot and the delivery attempt classed as failed. If the delivery attempt is failed there will be a £30 re-delivery fee to be paid by you, the customer, before we are able to send the goods back out. If you wish to cancel the order after a failed delivery attempt you are entitled to a full refund less the original £30 delivery charge.

Worktops, breakfast bars, splashbacks and upstands need to be checked on delivery and refused if any damage is found to be present.

If part of an order is damaged on delivery, please accept all of the order but make a clear note on the delivery note about which item(s) are damaged. Notify us within 24 hours and we will arrange collection of the damaged item(s) and delivery of the replacement item(s). Do not refuse delivery unless all items are damaged.

If someone other than yourself is taking delivery of goods, and sign for the goods on your behalf, you agree to advise them that the goods must be checked and you as the customer accept full responsibility for any damage or losses if they sign on your behalf without properly checking the goods.

We cannot accept or even consider any claims for damages or shortages if we are not informed of such within 24 hours after the delivery has been accepted by you the customer.

As the customer you accept full responsibility for any loss or damage to the goods once signed for.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery dates given upon order acceptance are approximate, and no liability whatsoever is accepted by us in respect of late or faulty deliveries. Do not arrange for any installers, kitchen fitters or other work persons to install the items until after they have been delivered and checked for discrepancies and to make sure the item(s) are undamaged.

Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and bank holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

If you are not home to take delivery of your goods or do not inform us of your inability to take delivery of goods within 48 hours of your delivery date, you may be charged a re-delivery fee.

As the customer you accept full responsibility for any loss or damage to the goods once signed for.

If you are collecting your goods from our Dewsbury depot, this must be during our opening hours which are available on our website or via Google, and on a day that has been agreed prior to your collection. Our staff will be able to assist you with loading products, however it is your responsibility to ensure goods are loaded safely and securely, and that you have the necessary transport and people to complete loading and unloading of your products.

We shall have no responsibility for any injury sustained by any person you engage to assist you with the collection of products from us or as a result of the loading them on to transport, unless such injury is caused by our negligence.

Upon collection you will be asked to inspect and then sign off on your goods. We take no responsibility for damage to goods during transit regardless of whether we assisted you in loading prior to you leaving.

Right to Cancel and Receive Reimbursement

If you are a customer living in the United Kingdom or the Eurpoean Union you have the right to cancel your contract to purchase goods from us within 14 days without giving notice. The cancellation period:

- Will end 14 days from when you receive, or someone you nominate receives, the goods when you purchased good(s) in one order that are all delivered together;

- Will end 14 days from when you receive, or someone you nominate receives, the last good when you purchased goods in one order that are delivered separately; or

- Will end 14 days from when you receive, or someone you nominate receives, the first good when you purchased goods that will be regularly delivered during a defined period of time.

To exercise your right to cancel you must inform us of your decision to cancel within the cancellation period. To cancel, contact us by email at [email protected] or by post at Units 1&2 Heatseam Business Park, Ravensthorpe Road, WF12 9EG. You may use a copy of the Cancellation

Form, found at the end of these Terms and Conditions, but you are not required to do so.

The right to cancel does not apply to:

- Goods or services, other than the supply of water, gas, electricity, or district heating, where the price depends upon fluctuations in the financial market that we cannot control and that may occur during the cancellation period;

- Custom or personalised goods;

- Goods that will deteriorate or expire rapidly;

- Alcoholic beverages where the price has been agreed upon at the time of purchase, delivery of them can only take place after 30 days, and their value is dependent on fluctuations in the market that we cannot control; and

- Newspapers, magazines, or periodicals, except for subscriptions to such publications.

Effects of Cancellation

If you cancel your contract with us and goods have already been sent to you, then you must return the goods to us as soon as possible after informing us of your decision to cancel. You will be responsible for the cost of returning the goods.

We will not be responsible for any damage or loss to the goods that occurs before they are returned to us, including while the goods are in transit.

If you cancel your contract with us, we will reimburse to you all payments we received from you under the contract, including the costs of delivery, except for any supplementary delivery charges resulting from your choice of a delivery type other than the least expensive type of standard delivery that we offer.

Please note that we are permitted by law to reduce your reimbursement to reflect any reduction in the value of the goods that was caused by handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

We will provide the reimbursement without undue delay and no later than the earlier of 14 days after we receive back from you any goods supplied or 14 days after you provide proof that you have returned the goods. If no goods were supplied, then we will provide the reimbursement no later than 14 days after the day we were informed of your decision to cancel.

We will make the reimbursement using the same form of payment as you used for the initial purchase unless you have expressly agreed otherwise. You will not incur any fees because of the reimbursement.

This right to cancel and to reimbursement is not affected by any return or refund policy we may have.

Refund requests must be made within 14 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

- Goods are damaged or broken (any damages must be reported within 24 hours);

- Incorrect goods were provided;

- Goods are the wrong size;

- Purchaser changed their mind; or

- Goods do not meet the purchaser's expectations.

Refunds do not apply to the following goods:

- Clearance items;

- Bespoke items, such as cut-to-size worktops; and

- Non-stocked (special order) items.

Returns (Faulty)

Returns can be made in person to our Dewsbury showroom or by courier. If a product is faulty, you must notify us within 24 hours of receiving your goods.

We cannot accept or even consider any claims for damages or shortages if we are not informed of such within 24 hours after the delivery has been accepted by you the customer.

If returning by courier, please carefully pack your goods and deliver them personally or via courier. You are responsible for ensuring goods are safe and secure during transit, and for the cost of returning any items to us.

The majority of products supplied come with a 12 month manufacturer’s guarantee. When products are stated as having longer guarantees, these guarantees are covered by the product manufacturer and not White Rose Group Ltd.

All returned faulty goods are tested by the manufacturer. If the item is found not to be faulty the product value will be refunded minus the cost of the testing process.

Please note we cannot accept any returns or refunds on goods that have been opened, cut or installed. It is your responsibility to check and ensure goods are suitable for use prior to unpacking and installing.

Returns (Non-Faulty)

Returns can be made in person to our Dewsbury showroom or by courier.

You are able to return your goods to us if they are non-faulty within 14 days of receiving your order - this is known as your “cooling off period”. Please contact us as soon as possible if you wish to return your non-faulty goods.

In the event of wanting to return your non-faulty items, you will be responsible for returning the goods to us in good condition and at your own cost. You have responsibility of care by law to ensure that the goods are received by us in a good and unused condition.

We reserve the right not to accept any goods where the packaging is damaged or defaced and therefore unsuitable for resale.

Please note that any items that you wish to return that are not faulty may incur a 30% re-stocking fee. You are also responsible to cover the return delivery costs and ensure that all items are received by us in a brand new, unopened, undamaged, re-sellable condition.

Returns (In-Store)

For faulty good bought in-store, the same terms apply as above.

For non-faulty goods bought in-store, returns can be either exchanged for another product, or a credit note for the value of the returned products. Refunds will only be given at the manager's discretion, and a 25% restocking fee may apply.

If collection is required, a collection fee will apply and will be confirmed ahead of booking in your collection. The customer must ensure there are able-bodied people at the collection point to assist the driver with loading the goods onto the vehicle. If nobody is present to assist the driver in loading, the collection will be failed and no further attempts will be made to make the collection. No refund will be given on the collection charge.

The above does not effect your statutory rights.
